Nexcess Warns Hosting Clients Of The Risk Of Ignoring The GDPR

Nexcess, a leading provider of performance-optimized WordPress and Magento hosting, has warned hosting clients that they are rapidly running out of time to prepare for the implementation of new EU privacy regulations. The EU’s General Data Protection Regulation (GDPR) comes into effect on May 25, and will impact all hosting clients that collect or process the data of EU citizens.

Although businesses based in the US and other locations outside of the European Union are not typically bound by European legislation, the new framework applies to all organizations that do business in the EU. In the global marketplace of the web, that includes eCommerce merchants with EU customers, publishers with an EU-based audience, and application and service providers with EU users.

The penalties for breaching the GDPR are onerous and include fines of up to €20 million (around $25 million) or 4% of worldwide annual revenue. It is in the interest of hosting clients around the world to familiarize themselves with the requirements of the GDPR and to take steps to comply.

“We provide hosting for websites and eCommerce stores in the US and Europe, and we are concerned that some hosting clients may not realize that the GDPR affects them and how best to prepare for May 25th,” commented Chris Wells, President and CEO of Nexcess. "We would urge all online businesses that collect, even incidentally, personal data associated with users in the EU to familiarize themselves with the GDPR and what it requires of them.”

EU privacy regulations have long been stricter than those of other areas, but with the introduction of the GDPR, EU citizens gain more rights and those who collect and process identifying personal data from EU citizens gain more responsibilities.

The most important new responsibility for web hosting clients is that EU citizens must give consent before their data is collected. Consent must be actively given so opt-out interfaces should be changed to opt-in. EU citizens also have the right to access any personally identifiable data a company holds and to request the deletion of any such data. Businesses are expected to provide accessible interfaces for users to make requests for data access and deletion.

Furthermore, all businesses that handle identifiable data of EU citizens are required to inform customers of data breaches involving their personal data within 72 hours. Regulatory authorities in individual EU nations will be given powers to perform on-site audits and to warn, reprimand, and issue remediation instructions to businesses found to be non-compliant.

US stocks are poised for another rocky session after the resignation of President Donald Trump’s chief economist, former Goldman Sachs banker Gary Cohn, in protest against the president’s proposed tariffs on aluminum and steel imports.

Beyond any immediate market nervousness about trade wars, there’s a bigger threat to the US economy from Trump’s egregiously anti-social behavior on the global stage, which is antagonizing key allies ranging from Canada and Mexico to the European Union.

That danger is America’s slowly eroding global image as a reliable trading and diplomatic partner and thus the world’s preferred investment destination, Susan Aaronson, trade expert and professor of international affairs at George Washington University, told Business Insider.

Aaronson, also a fellow at the Canada-based think tank Center for International Governance Innovation, says she’s deeply worried about "the damage to the trading system — and also long-term funding of the US budget deficit."

That’s because foreign governments hold more than one-third of the US government’s $14.6 trillion in Treasury bonds outstanding. About one-third of the US stock market is also owned by foreign investors.

This helps keep borrowing costs low and the economy humming.

"We need foreigners to view us as a stable, wonderful place to invest in," Aaronson said. "Instead, they may be under political pressure to punish us because of our bad behavior. And when you set a precedent others will also misbehave. This what happens when you put in an amateur staff in charge of public policy."

China is a case of its own and not a major concern as far as possible Treasury sales — its yuan currency is pegged to the US dollar, and therefore any attempt to dump American bonds en masse would immediately backfire by tightening financial conditions at home, likely sending its economy into recession. Other major nations, however, have other options, particularly with yields on European government debt gradually rising.

Because bond prices more opposite to their yield, any large-scale dumping of US Treasuries would lead to sharply higher borrowing costs and interest payments for not only the US government but also corporations and consumers. A recent uptick in bond yields has already unsettled global stock markets, who fear monetary tightening from the Fed could tip the economy into recession.

Aaroson, who has advised the Canadian government on trade policy over the years and spends a lot of time there, said the country’s policymakers, who were in the midst of renegotiating the North America Free Trade Agreement, are "in a state of shock" over Trump’s tariff announcements.

"Their closest neighbor and ally is treating them like an enemy," she said. "Who does Trump really work for? If he worked for the American people he would see the benefits of the strong alliance with the UK, Canada, Brazil, Mexico, other democratic regimes."

Not to mention Japan, Australia, and others, which were put off by Trump’s withdrawal from the TransPacific Partnership Agreement after years of negotiations between 12 nations in the region.

"Who benefits from this disruption of trading relationships?" Aaronson asked. "That needs to be explored more.

Mr. Reuss leads the design, engineering, safety, quality, research and development, advanced vehicle technology and program management of General Motors cars, trucks and crossovers around the world. He also oversees GM’s Global Purchasing and Supply Chain organization, and is a member of the GM Executive Leadership Team and the board of Shanghai General Motors (SGM).

From 2009-2013, Mr. Reuss was President of General Motors North America, responsible for GM’s performance, manufacturing, portfolio and dealer network. Under his watch, GM’s North America region produced consistent profits and improved margins during a product renaissance featuring a slate of award-winning vehicles.

Previously, Mr. Reuss served briefly as GM’s vice president of global engineering after spending two years overseas as vice president and managing director of Australia and New Zealand. During this time, he was a member of the GM Asia Pacific Strategy Board.

Mr. Reuss is a mechanical engineer who began his GM career as a student intern in 1983. He has held numerous engineering and management positions, including chief engineer of GM’s large luxury vehicles and manufacturing body shop tooling launches.
